As per the Immigration and Nationality Act, there are two family-based immigration categories for family-based immigration in West Palm Beach. Those are for immediate relative immigration visas and family preference immigration visas.
Immediate Relative Immigration Visas
These types of visas are for close family relatives of a United States citizen. The person being petitioned into the country is an immediate relative. No limits have been imposed on immediate relative immigration visas. Eligible relatives consist of the following:
- The spouse of a U.S. citizen.
- Children under the age of 21 of the U.S. citizens who have not been married.
- Orphans adopted abroad by U.S. citizens.
- Orphans adopted in the United States by U.S. citizens.
- The parent of a U.S. citizen who is at least 21 years of age.
Family Preference Immigration Visas
These visas are for more distant relatives of U.S. Citizens and some lawful permanent residents. Limitations are placed on these visas for every fiscal year. There are four categories of these visas, and the number of visas allowed to be issued each fiscal year appears next to the type of the visa. The categories consist of the following:
- First Preference: These are the unmarried sons and daughters of a U.S. Citizen and any of their minor children. (23,400)
- Family Second Preference: The spouses, minor children and unmarried children over the age of 21 of lawful permanent residents. (114,200)
- Family Third Preference: The married children of U.S. citizens and their spouses and minor children. (23,400)
- Family Fourth Preference: Brothers and sisters of U.S. citizens and their spouses and minor children, so long as the U.S. citizen is over 21 years of age. (65,000)
Should the number of qualified applicants exceed the number of visas, the applicants must wait until the following fiscal year based on filing dates.
